International humanitarian law distinguishes between detention and internment in situation of international armed conflicts but not in non-international armed conflicts. It may take place in times of peace but also of armed conflict.

Detention for administrative or security reasons is usually called internment and decided by administrative or security bodies. Detention is a measure that deprives an individual of his or her freedom and is enacted pursuant to a decision taken by a judicial body for criminal or administrative reasons. Traditional international law makes a distinction between detention and internment.
